Washington (CNN)The White House is preparing a draft proclamation for President Donald Trump to declare a national emergency along the southern border and has identified more than $7 billion in potential funds for his signature border wall should he go that route, according to internal documents reviewed by CNN.
Trump has not ruled out using his authority to declare a national emergency and direct the Defense Department to construct a border wall as Congress and the White House fight over a deal to end the government shutdown. But while Trump’s advisers remain divided on the issue, the White House has been moving forward with alternative plans that would bypass Congress.
“The massive amount of aliens who unlawfully enter the United States each day is a direct threat to the safety and security of our nation and constitutes a national emergency,” a draft of a presidential proclamation reads.
“Now, therefore, I, Donald J. Trump, by the authority vested in me by the Constitution and the laws of the United States of America, including the National Emergencies Act (50 U.S.C 1601, et seq.), hereby declare that a national emergency exists at the southern border of the United States,” the draft adds.
The draft was updated as recently as last week, a US government official told CNN.
According to options being considered, the administration could pull: $681 million from Treasury forfeiture funds, $3.6 billion in military construction, $3 billion in Pentagon civil works funds, and $200 million in Department of Homeland Security funds, the official said.
As lawmakers discussed a short-term measure to fund the government Thursday, Trump again raised the prospect of other ways to fund a border wall without congressional approval.
“I have other alternatives if I have to and I’ll use those alternatives if I have to,” he told reporters.
“A lot of people who wants this to happen. The military wants this to happen. This is a virtual invasion of our country,” Trump said.
I want to make four important points about this prospective course of action being considered by the President:
1) If the President does do this, it does not also mean that it then clears the way for the shutdown parts of the government to be reopened. While it may free the majority Republican caucus in the Senate to move a clean continuing resolution, it also frees the President up to just ignore it. He’ll have gotten what he wants, immediate funding and the gratification that comes with it, for his wall. At that point there’s no pressure on him to sign any continuing resolutions or appropriations bills. Regardless of what Republican senators and/or conservative pundits might think, this doesn’t break the logjam preventing funding to reopen the shutdown portions of the government. Rather, it relieves any pressure on the President to actually reopen them as he will have found a way to unilaterally get what he wants, which removes all the pressure being brought to bear on him.
2) If the President crosses this line and declares a national state of emergency regarding border security, he’ll quickly become addicted to it. Some of this will be because of the rush of violating norms, rules, and traditions in a very public and very large scale way. Some of this will be because of all the attention he’ll get from doing so. And some of this will be because he will suddenly have a new toy to play with. If he does this for a fictional border security crisis, he’ll also do it for his other factually inaccurate but deeply held fetishes: multilateral trade agreements that are ripping the US off, Chinese currency manipulation, multilateral military and national security alliances that are taking advantage of the US – none of which are actually happening. And as was the case with his military transgender ban, he’ll be encouraged to use his transgressive new powers for a variety of other hard right dreams such as rewriting US immigration law (which he actually publicly considered doing several months ago), outlawing abortion, declaring national constitutional or reciprocal carry of firearms to ensure Americans can defend themselves against the terrorists, gang members, and drug dealers that are not actually poring over our southern border, etc.
3) While the lower courts, including many of the Federal Courts of Appeal, will overturn this proposed action of declaring a national emergency on the southern border to reallocate funds without Congress’s consent to build his wall, and enjoin them from taking place, the Supreme Court will uphold the action. The one constant in the nominations and appointments of Chief Justice Roberts and Associate Justices Alito, Gorsuch, and Kavanaugh is that they all hold the most expansive views possible of executive branch and presidential power, especially when the president is a Republican. As much as they may or may not overturn a variety of precedents such as Roe V. Wade or try to reinstate the Lochner era of Federal jurisprudence, they were chosen to rubber stamp the executive branch and presidential actions of what Karl Rove thought would be a permanent Republican majority America, where the Congress would have a GOP majority and the president would be a Republican for at least a generation.
4) If we’re lucky enough that the President, should he actually declare a national emergency on the southern border in order to reallocate funds without congressional approval to build his wall, and not actually decide to use this power over and over again, Republican elected and appointed officials, as well as conservative commentators, think tankers, and legal scholars need to prepare themselves for a future Democratic president, perhaps as early as January 2021, declaring a national emergency regarding climate change and thereby forcing the Green New Deal. Declaring one regarding income inequality repealing all the tax cuts since the 1960s. Declaring one that Justice Gorsuch, as well as all the Federal district and appellate court justices who are were confirmed because McConnell refused to allow confirmation of Obama’s nominees, all received stolen goods when they were confirmed and sworn in on the Supreme and other Federal courts, and therefore increasing the size of them and filling those appointments without the Senate’s advise and consent to prevent the GOP from further ratfuckery in Federal judicial appointments. And declaring one regarding mass shootings and school shootings in order to radically reinterpreting the 2nd Amendment and force gun safety measures.
Violating norms, ignoring traditions, and breaking rules are sometimes necessary. None of them should be done for trivial reasons, which includes process reasons, which includes a declaration of national emergency to allocate funds that Congress has not and will not appropriate for a border wall. Violating this norm, issuing a national emergency because the President cannot get Congress to go along with something he wants, is unwilling to negotiate in good faith, and has run out of other options to achieve his goals, creates a very dangerous precedent. We will be lucky, should the President decide to issue such a declaration, that it is just a one off and that future Democratic majorities in Congress and a future Democratic president can agree to revise the law regarding national emergencies and rebalance power back to the legislative branch. Unfortunately, we are more likely to see this President to become addicted to his new toy and try to use it over and over and over again. Republican officials, like Senator Graham, will rue the day they encouraged the President to do this. Unfortunately the rest of us are going to rue it too. It will not only be a massive violation of norms and rules, it will also be a massive threat to national security and that threat will be coming from the Oval Office aided and abetted by the Republican majority Senate and Republican nominated and approved conservative majority on the Supreme Court.

I know that is more expensive than simply letting them buy a bullet, but those kinds of endings usually begat martyrs and lets face it, the GOP adores being “persecuted” and holding their villains up as heroes. If so, that would potentially open the door to a 10-15 year state of emergency. Or a perpetual state of emergency as the demand for a national security wall consumes the nation. It’s getting awfully close to the point where the least-unpalatable resolution left is the venerable Turkish Army solution: Depose the government & rule by fiat, try the top officials in military court for treason & execute them, clean out the corrupted lower echelons (possibly imposing lifetime bans on political activity), then hand power over to a civilian caretaker government which plans for new elections. The Army did this several times between 1960 and 2016, & returned civilians to power after brief interregnums (interregna?).
No one in their right mind thinks this is would be a good outcome. But it may be the least-bad option remaining.
The problem is, the Türk ordusu (before Erdogan Islamized it) considered itself the primary guardian & guarantor of the secular republic (Cumhuriyet) founded by Atatürk after overturning the Treaty of Sèvres & expelling the Greek army from Anatolia in 1922. Is there any equivalent sentiment in the US armed forces to return us to the rule of law? Doubtful at best. The military has never been happy with civilian control & an emergency culminating in a junta could last a long, long time… :^(

It’s important to understand that an emergency declaration over the wall is a declaration of a specific emergency that will require specific responses. It might let the president redirect funds to wall spending and avoid some legal obstacles to construction, but it wouldn’t create a general emergency that would allow him to suspend legal obstacles unrelated to the putative emergency. The worry is that if it works, he will resort to further emergency declarations every time he fails to get his way.

I find it impossible to think SCOTUS would grant this power now, and then in ~2 years suddenly pull it away for a D Pres, without the Roberts court losing every last ounce of credibility. Hi,
I’m in Arizona boonies with my cousin, B. We got here Tuesday, and found that the solar power system was DOA. We had flashlights to build a fire and the little propane heater we used prior to the woodstove installation also fired up. We had bottled water– duh, its a desert! and stopped at a grocery for bachelor foodstuff.
We have been comfortable, but busy. Our Solar installer guru came out today, next day service, and determined that the battery bank had reached end-of-life (lead acid batteries are typically good for 7-8 years of heavy-duty service) but that the inverter/controller/solar panel bank were all 100%.
So I’m considering the cost of new batteries, the previous bank was 16 batteries cabled together at 48-volts. Currently the Honda generator we used to power the construction is wired into the house wiring, the water pump is powered, and we’re good to go. Solar guru tells us we have had more battery than needed to avoid the need to the generator, intended for cloudy times, and with the generator installed for such purposes we can get by with 8 batteries. We used the generator to build the house, and it started after 2 or 3 pulls after sitting idle for like 6 years! Go little Honda!
Wonderfully, we have been 98+% off the grid, and are unaware of the details of current events, all of them. We’re about 25 miles north of the Mexican border and ARE NOT OVERWHELMED by the drugged invasion. Tourism at the border ( Bisbee) seems normal, and we see vehicles with license plates from Sonora State doing normal business. Amazing!!
I guess I’ll read the original post, as a current resident of the border catastrophe emergency, it may be my patriotic duty to be informed about the “battles” raging around my little hill in the Dragoon Mountains of AZ…

I remember reading that piece and I found it so bleak that I thought it would better to just launch the missiles now and get it over with quickly. It made a point of mentioning that decades after the Trump presidency has ended, global climate change will still be here and will wreak havoc on civilization.
In general, I feel human civilization is moving towards greater rationalization, which can be a good thing and a bad thing. Good, because it means society is more organized to respond to specific problems, both internal and external, ie natural. We have developed rules and standards that save lives in healthcare for example (sterile technique, shorter hospital stays to prevent HAIs). Violent crime has been falling for decades as well. Bad because I believe it can lead to a stifling of human creativity and freedom at the same time; Max Weber’s Iron cage in other words. The law is followed according to the letter, instead of the spirit, like what happened to the volunteers leaving food and water along the Southern border for migrants recently. They were fined and threatened with jail-time for essentially trespassing. The law was used to penalize these people for doing the right thing.
Laws, societal norms, and disinformation will be used to maintain authoritarian regimes as in Turkey or Russia, but I fear this increasing societal rationalization and bureaucratization could lead to stripping humanity of its humanity, at least as we understand it.

The new AGM sealed batteries are good for 25 years, and are now about the price per cell that you would have paid 20 years ago for lead acid.
Battery banks can either be sized to the panel array, ( full charge, 1 day), or they can be sized to use, ( topped up by the generator).
Which way you go, depends on use.

The best way to game the Supreme Court into doing the right thing is to emphasize point #3. All Democratic Presidential candidates should make clear that they think that the President shouldn’t be allowed to randomly declare national emergencies to sidestep Congress, but if the Supreme Court disagrees, they are prepared to use that power on all of those issues that Adam mentioned.
Too often, conservatives think that they can break things because Democrats won’t dare to do the same thing. It needs to be explicit that we will, if given the opportunity. So, it’s better for all to keep that Pandora’s Box closed.

i don’t understand point 1. if congress sends a clean CR to the president’s desk and he ignores it, it becomes law and the government reopens. it’s only a pocket veto if both houses are in recess, and i’m sure pelosi would make sure the house stays in a pro forma during the time it takes to sit on trump’s desk.
seriously, if we can get a CR passed, trump would have to deliberately veto it.

i think he’d likely ignore it and the government would reopen a week and a half later and he’d shrug his shoulders cause he “got his wall”. at least us feds would go back to work while the wall gets immediately tied up in the courts.

We have more that that. Trump wants $5 billion for his wall NOWNOWNOW and he may be willing to declare a fake emergency to get it, but that’s only good through September 30th. How does he get it into the FY2020 budget — declare another emergency? Stamp his little feet? Hold his breath until he turns blue? I’m not a lawyer, but I’m not too sure that declaring a national emergency means that Trump gets to write his own budget.

He really doesn’t care. At all. He cares about having power and using it to make other people do what he wants. The wall has become a sticking point not because he actually wants it, but because getting it would prove that he’s in control, not Nancy Pelosi. And narcissists are the original “give an inch, they’ll take a mile” assholes. If Congress gives in and includes wall funding, he will threaten to declare an emergency every time he doesn’t get his way, and for increasingly smaller things. He’ll start saying that he’ll declare a national emergency if the Senate doesn’t approve Jared as Attorney General and Ivanka as Secretary of State.
I know that Pelosi knows this. I hope the rest of the Democrats do, too.

I don’t think indictments are going to get handed down until after we have enough public hearings before the house intelligence committee. People know there are investigations taking place but I don’t think the seriousness or scope of what happened has gotten through to the majority of Americans. 6.8 billion taken from military construction and USACE to fund Wall would touch every red state, all the navigible water and ports of the nation. The whole fy18 Army Corps works budget was 3.8B and he wants 3B of that? … No congress critter, red or blue is going to stand for it.
Military construction is ~10B/yr typically…pulling 40% of that for Wall is going to mean a lot of facilities in mostly red States aren’t going to get built.
