Back at the end of May, Illinois became the thirty-seventh state to ratify the Equal Rights Amendment. (Thirty-eight states are required for ratification.) Even though I didn’t post about it at the time, events of the past few weeks have confirmed my conviction that embedding the ERA in the Constitution is one of our best weapons against the creeping authoritarianism of the revanchist GOP and its dishonest brokers in all three branches of government. And I’m not alone!
Supreme Court Justice Ruth Bader Ginsburg in 2014 remarks at the National Press Club said if she could choose any amendment to add to the US Constitution, it would be the Equal Rights Amendment. “I think we have achieved that through legislation, but legislation can be repealed, it can be altered,” Ginsburg continued. “So I would like my granddaughters, when they pick up the Constitution, to see that notion — that women and men are persons of equal stature — I’d like them to see that is a basic principle of our society.”
It will probably not come as a surprise that the states which have so far failed to ratify are those of the Confederacy, plus Utah and Arizona. That doesn’t mean any of these states are unflippable, not even Arkansas (hello, Senator Doug Jones) or Georgia. The original 1970s impetus to revive the ERA — which, it should be remembered, was first proposed in 1923 — was vitiated by a series of state-level legal and social changes. But Anthony Kennedy’s retirement, and the Reichtwing jubilation greeting the Oval Office Occupant’s chance to steal another seat on the Supreme Court, make it clear that the ERA is every bit as essential to our continued existence as a free nation as the Thirteenth, Fourteenth, and Fifteenth Amendments. Without protection at the highest level, our rights to equal protection will never be more than provisional.

That remaining calm during the day took its toll last night, though.

Ironic how we have to keep fighting battles already won once.
So many Gen X and millennials just can’t imagine a world without easily available birth control, for example. The original deadline was March 22, 1979. That was later extended to June 30, 1982. Wikipedia says that therefore it is unclear whether Nevada’s ratification in 2017 and Illinois’s in 2018 are legal. Probably awaits a court test.

@?BillinGlendaleCA: They are looking to erase all the Progressiveness that has come from anything for the last 120+ years.
They won’t stop until their idea of a proper chokingly conservative world comes to furition, and if they have to beat progress down with the arm of the State, then they will.
So anyone on the side of continued progress, as halting as it is, need to take stock and assess to figure out what we are going to do not only tommorow, but next year, the next 5 years, the next 10, the next 20, the next 40, etc etc.
We didn’t get here in 18 months, it’s taken the Right-Wing 50+ years since Brown to create these conditions, and maybe it will take longer to right the ship, maybe shorter. But the one thing we can’t do is say “It’s all fucked, where’s the meteor”.
Because at that point, they truly have won. They don’t truly win until they break us and we give up. Lord knows they didn’t quit after Brown, the VRA, Medicare, the Civil Rights legislation in general, Roe, and so on were decided. So if they do get the chance to overturn it, then we steel ourselves to put it right back.
If the public wants political war where things whipsaw back and forth depending on who is sitting in the chair at any given time, well… a wiser man once said “now is a time for choosing”, they had better get to choosing what world they are gonna live in instead of just coasting on the inertia created.

Meanwhile, here’s a depressing story out of Florida:
This week, new polling data shows why Scott’s decision to offer Trump public birthday wishes may be viewed favorably in his home state: Among likely voters, Trump’s approval rating has risen to 53 percent, a CBS News poll found. In that same poll, Scott tops Nelson by 46 percent to 41 percent, but an NBC News/Marist survey released a day earlier had Nelson leading 49 percent to 45 percent.
How the fuck could 53% of any group of people approve of Trump? What the fuck is wrong with this country? Other than praying for him to stroke out while on the toilet, it should be impossible for more than 50% of people coming together on anything regarding Trump.
I’ve come to the conclusion that Mueller is our only hope, because its obvious that if Trump officially surrendered the country to Putin at least 40% of the people in this country would cheer him on.

Hence all this kvetching about how the Democrats could have a permanent majority of 60+ Senators and 230+ Representatives if they only just did ‘this’ or ‘that’.
People have to learn that nothing is permanent; and everything you do, no matter how right you think it is, will produce a backlash. The question is being able to blunt the backlash and proceed along with progress anyway. I think that’s where the left, if I have to fault it somewhere in the Obama years, failed. It didn’t know how to deal with the ‘counter-revolution’, if we want to call Obama’s election a revolution.

In other words, Trump Voters want the government to bend society and culture back to what it was when conservative thought was prime; and if it can’t, it will call for elected officials even more insane and crazy to make it.

They don’t know that it will be “massive”. They’re all promoting the idea it will be massive, and beneficial to Trump, but they don’t know that’s true. It could also bring out anti-Trump voters as they realize he’s solidifying one Party power in all three branches with no oversight or accountability.
They are really far Right now and the “institutions” that were supposed to provide some check on them are failing one and after another, like dominoes. Reining them in at the lowest level, with individual votes, is literally the last check on them that is still standing.
That’s a pretty compelling argument for Democrats and that’s the traditional midterm argument- that the Party in power is over-reaching and should be checked.
I don’t want to let political media talk us out of participating or resisting this. They are trying to set a narrative where it isn’t worth it for Democrats to vote, that we all have to bow to King Trump like they do. We still have votes (well, some of us, in some states). How many times did Republicans repeat over and over again “You didn’t build that”?* They built their entire Romney-nominating convention around that one phrase, which they repeated over and over and over again. Trump talking about Roe being a thing of the past should be on constant twitter rotation. We need our own bot army.
Also we should keep reminding people that Trump said, on camera, that THERE MUST BE PUNISHMENT FOR WOMEN WHO GET ABORTIONS. When the forced-birth crowd pointed out to him that you aren’t supposed to say that because it’s politically a massively losing issue, he stopped. But that is what he said. Force him and his people on the defensive about it. Have commercials 24/7 with Trump saying it. Over and over again.
*Dishonestly, of course, since Obama was referring to things like the roads in front of the business and the sewer system, not the business itself when he used “that”. Where was that Republican fascination with context that suddenly appeared when Trump was smearing immigrants as “animals”?

@Cheryl Rofer: If they didn’t want to go to deportation court, they shouldn’t have crossed the border. Although I snark having a three year old go to court does untold damage on the child. I’d like to think it would do untold damage on the judge, and others in attendance but I feel they probably sold their soul ages ago.

We’ve had far Right Supreme Courts before. This is worse because we also have a far Right President and far Right Congress and our “institutions” are falling over like lawn chairs in a stiff wind, BUT, we’ve had far Right judges who didn’t reflect the vast majority of the country before, and we overcame them eventually.

My pet peeve is that MSM is talking about banning abortion. All the court can do is ban safe abortion, unless they want to imprison females.
The court can also revisit public education for children of undocumented immigrants.

Oh, the things Balloon Juice does to my mind. So I clicked on the musical interlude thread last night and enjoyed the Beach Boys songs. It is now an earworm this morning. But it morphed into Kokomo, a very perverse version of Kokomo. The chorus of “Aruba, Jamaica, ooh I want to take ya” has been replaced with one of the rotating tag lines. So my brain is singing “enormous, mendacious, disembodied anus”. Please make it stop.

@Cheryl Rofer:
It’s ludicrous, Cheryl and they know it. They’re doing it because that’s the process but they all know it makes a mockery of the court and due process and it must be incredibly depressing to take part in any of it because it’s a SHOW. It means nothing. It’s a fake hearing. They know 3 year olds can’t explain why they need refugee protections. It must be soul-killing, taking part in it. The defense lawyers will make broad arguments but obviously they can’t get specific information from a 3 year old, so they’re just talking to fulfill the requirement of a “hearing”.
They’re making a mockery of their own court system. They all probably hate it but that’s what they’ve been given so that’s what they’ll do.

@Soprano2: “fearmongering” is obviously one of the go-to words in the playbook. Whenever there is something that is politically unpopular that you plan to do, say that the people who point out your plans are “fearmongering” and don’t discuss it any more. Don’t let them skate on this.
Case in point: When Michigan had a referendum on gay marriage, the proposal was crafted so broadly that it would make domestic partner benefits illegal for state-associated employers (universities, for example). When the RWNJ attorney general was asked about this, he dismissed it as “fearmongering”. After the referendum passed, that same attorney general filed an anti-domestic partner benefits lawsuit the very next day, indicating that he had had it prepared and waiting for awhile.

They do want to imprison females. The idea that far Right law won’t include punishment provisions is ludicrous. Of course they’ll imprison women. They say abortion is murder. They have to charge and try and punish people for murder. One of their intellectuals wants women hanged for abortion, for God’s sake. That idea is acceptable on the Right.
If they DON’T imprison women it could end up even worse for women, because that follows the far Right idea that women are as children- not adults with agency and the capacity to make decisions and be responsible for them. That’s worse.

Forget the old ERA. The Dems should say that when they retake Congress, they’ll start a new ERA, and this one will include equal rights for gays and transgender persons as well as women.
Actually, they should promise a whole slate of amendments:
1) New, improved ERA
2) Voting rights (everybody 18+ gets to vote, no exceptions, no one can be barred from voting or have their vote not counted without the state or locality proving why that individual is ineligible in that locality)
3) Banning imprisonment due to debt, including inability to pay fines and fees
4) Right to privacy
5) Right to organize for purposes of collective bargaining
That’s off the top of my head. Might be able to think of one or two more, given time.

I have some good friends who are lawyers, and then again there are lawyers I have asked other friends not to bring around to our house again. Like any group, there are good people and bad people in the group. Obviously the AG you speak of is a lying despicable rat bastard type of lawyer.
The guy we asked not to be brought around again fought workers comp cases for the employers. Best story about that, they had a “private eye” videoing an injured former employee, and caught him both painting his house, an activity much less stressful than working underground in a coal mine, and then carrying a heavy concrete bird bath around his yard. He was painting for about an hour each afternoon, and making slow progress.
In court, they showed that video of him carrying the bird bath around, and then his lawyer picked it up with one hand – it wasn’t concrete at all, it was plastic. Judge was not happy with Tom’s lawyering, and said so pointedly. They were ordered to leave their victim alone henceforth. But that was his job, full time, every injury case was fought as if it was a death penalty case. Horrible in my book. Almost as bad as the AG in Michigan lying to screw gay folks.

@Sister Rail Gun of Warm Humanitarianism: yep. I knew it would happen. Deportation involves quite a lot of cruelty, especially to long time residents who are snatched. It easy to rile up voters about gangs and whatnot, and that has to be done because deportations are cruel. So when he promises to deport 8 or 12 or 20 million, I knew it would end like this. There aren’t enough gang members to get 8 million deportations. Lots of working families, though.

They took an 8 month old away from his mother to punish her for the equivalent of a misdemeanor. You really think they won’t prosecute women for abortion, which they describe as “murder”?

Ivanka’s on another promotional campaign. The “conversations” she had with “dad” are being promoted, by dad and Ivanka.
It must suck to be an elected representative dealing with her. The Senate is reauthorizing the law for career and technical education. Everyone knows this will pass because it’s a 40 year old program and it’s popular.
Ivanka goes to the hearings. She’s figured out that if she shows up at “gimmee” reauthorizations she can take credit for popular programs. It would kill me if I were a Senator. It’s just such self-promoting bullshit and she’s making them all a party to it. I honestly think I would refuse to play along. Work so hard to become a senator and then watch as this phony manipulates the coverage to benefit herself. I could not go along with that. So much of capitulating to Trump involves a really profound lack of self respect. They’re humiliated- made smaller. Their work is devalued. But they do it to themselves.

No one., not a state, not a city, not a private adoption agency- NO ONE takes custody of someone else’s children and does not track them.
The Trump Administration did. They don’t believe those children are human. They treated them as having less value than property. They had no system in place to protect those children and return them to their family – they didn’t bother to put one in. You can only do that if you believe the 8 month old is not really a human being.
They knew NOTHING about those kids. Not a medical history, nothing. That 8 month old could have died in their custody. They don’t know anything about him. What if he had health problems, heart or lungs or an intolerance for baby formula? They didn’t care. They grabbed him anyway and shipped him hundreds of miles away.

Kennedy’s retirement is about abortion (but that’s not all it’s about)
06/28/18 09:22 AM
By Steve Benen
Soon after Supreme Court Justice Anthony Kennedy announced his retirement, Rachel told MSNBC’s Nicolle Wallace that the retiring jurist is “probably the reason we have abortion rights in this country, and I think within a year, abortion will be illegal in half of the United States.”
That may have struck some people as a bold, almost inflammatory, prediction. It wasn’t. This is simply a matter of being about to count to five.
Indeed, the likely scenario is already in sharp focus: Trump will keep his promise to nominate a justice who opposes abortion rights; Senate Republicans will confirm him or her; the Supreme Court will take up an abortion case; and Roe v. Wade will be overturned before the next presidential election.
