The retired wrestler Hulk Hogan was awarded $115 million in damages Friday by a Florida jury in an invasion of privacy case against Gawker.com over its publication of a sex tape.
The wrestler, known in court by his legal name, Terry G. Bollea, sobbed as the verdict was announced in late afternoon, according to people in the courtroom. The jury had considered the case for about six hours.
Nick Denton, the founder of Gawker and a defendant in the case, was found personally liable, as was Albert J. Daulerio, the site’s former editor in chief.
In his closing argument in the two-week trial, the wrestler’s lawyer delivered a lacerating attack on Gawker’s culture and guiding principles.
“It’s just porn,” the lawyer, Kenneth G. Turkel, told the six-person jury in St. Petersburg, Fla., considering the claim by the 62-year-old former wrestler that he was humiliated and emotionally shattered by Gawker’s 2012 publication of a secretly recorded video of him having sex with a friend’s wife.

The rationale used by Gawker was similar to that used by the douchebags who distributed and enjoyed the nude photographs of various female stars. Since they were public personas, they were fair game. If they ever appeared in a film nude or even in a provocative pose, then they had no right to privacy. If they ever discussed or alluded to their sex lives in interviews, they gave up any privacy rights.
We will see what happens on appeal, but Hogan made a fairly good case I think that his wrestling persona was a performance, and not the same as who he was as an individual.
I don’t see what public service Gawker was pursuing in trying to publicize this material.

I can see several ways they’re legally different. The biggest, most obvious one is that Andrews sued the person who filmed her and the hotels who let him do it, while Hogan went after the Gawker for publicizing his sex tape. That means they had to pursue completely different legal theories.

As for this case, it’ll be interesting to see what happens on appeal. Hogan brought the same suit in Federal Court and lost. This is why they switched to Florida state court.
And the big question, still unanswered, is who sent the tape to the folks at Gawker. Hogan has claimed it wasn’t him. The question is was it Bubba The Love Sponge (formerly Todd before he had it legally changed) Clem? Was it his then wife who is on the tape? I’m not sure it really bears on the case (or in this case is that bares?)

1) It’s not obvious that’s true. Plenty of non-celebrities have won huge judgments, especially when punitive damages are figured in.
2) In at least some cases, damages are based on on things that tend to favor the rich and famous. They earn more money, so damages based on lost wages are more. They are better known, so damage to their reputation is comparatively worse. And they’re more likely to attract a lot of interest, so damages based on how many people see their sex tape will be correspondingly large.

The announcer, Gordon Solie who was The Man back then lived 2 homes down from me. Not sure how Florida law reads on that, but wouldn’t they need something pretty major to pierce the corporate veil? Or, the simpler explanation is jury composed of six Florida Men.
Would also like to see the jury instructions. There has got to be reversible error there to get that kind of award.

Regardless of my personal opinion of Hogan, this verdict sets a good precedent, and will be helpful for future revenge-porn victims. It doesn’t matter if they’re a “public figure.” It doesn’t matter if he talked about sex. (Elizabeth Hasselbeck tried the same nonsense argument, slut-shaming Erin Andrews for wearing a skimpy outfit on Dancing with the Stars.) It wouldn’t even matter if Hogan or Andrews had consensually posed nude on some other occasion – that doesn’t mean the rules of consent no longer apply to them.
Gawker chose to disregard consent, and they’re paying for it. Even if the award gets reduced, the next Hunter Moore or .Michael David Barrett has a good incentive to think twice.

@Adam L Silverman: This judgement is way out of line when you look at other recent judgements for invasion of privacy and the process that this trial took. Gawker fully expected to be on the losing side a few days ago and planned on appealing. Also, the video leaked long before Gawker got its paws on it and Boella was in damage control-Gawker was the one website who had the deepest pockets he could go after. His career as a wrestler was long over a decade ago. And most damage awards on appeal usually get trimmed dramatically if they aren’t overturned outright (which this one has a chance of happening due to the video being leaked to other sites.)
