In order to keep a hip hop artist from Idaho (fka Bella Q) from completely losing it, here is the promised update on what has been going on with our old friends from the Malheur Wildlife Refuge Standoff. JJ MacNab brings us news that the DOJ will be bringing additional charges in regards to the Malheur Wildlife Refuge occupation. The question, as she posed it, is exactly who they’ll be going after? And will this include Ammon Bundy’s self described deep pocketed backers. The Center for Western Priorities has a nice piece up about the American Lands Council and the apparent collusion between them and Ammon Bundy. Ms. MacNab also reports that Bill Thornton, one of the graybeards of the sovereign citizen movement, will be joining the other self appointed judges (Judge Anna, Judge Doucette, etc) in Oregon in order to get the occupiers out of jail. Because what this needs is more fake lawyers and judges to go with the fake Constitutional analysis of Cleon Skousen.
HGTomato reports on twitter that the Washington National Guard is aware of the activities, online and in the real world, of disabled National Guard Staff Sergeant Maureen Peltier. And that she also has cognitive disorders in addition to her physical injuries. It is unclear what, if anything, the Washington National Guard will do in regard to SSG Peltier before her disability based discharge is completed. Gargoyle is also reporting on twitter about retired Marine Jerry Delemus. Delemus was in charge of the militia at the Bundy Ranch/Bunkerville standoff, is the co-chair of a veteran’s for Trump group, and is married to a NH state representative. He was also at the Malheur Refuge for a brief period of time as well. HGTomato has Delemus’s statements on the FBI.
Before we get to the links to the charging documents, let’s finish the roundup with Grant County Sheriff Palmer. Sheriff Palmer seems to be so compromised that the dispatchers on the night of the initial arrests considered him to be an insider threat of a security leak. They were worried if they told him anything, then he would compromise the attempt to take the Bundys, Finicum, Payne, and the other occupation leaders into custody. Les Saitz, on his twitter feed, has reported that Sheriff Palmer is being investigated and that could lead to his law enforcement certification being revoked. It is not quite clear what that means for his ability to remain in the elected position of sheriff.
Here’s the original Cliven Bundy charging document. And here’s the amended one that added Ammon and Ryan Bundy, Ryan Payne, and Pete Santilli.
—–Update at 11:23 PM —–
elftx just posted this analysis by Professor Susan Lea Smith of Willamette University on disbarred Florida attorney, Tea Party activist, and apparent sovereign citizen Kriss Ann Hall’s understanding of the Constitutionality of Federal property ownership. I had meant to include it in tonight’s update and simply forgot. Good catch elftx!

If Palmer loses his LEO certification – and he should – he can’t be sheriff because OR law requires sheriffs to be so certified. But as an elected official, he can only be removed by recall. I would expect that legal ineligibility would be enforced by a court, however.

Omnes Omnibus
@a hip hop artist from Idaho (fka Bella Q): Yeah, but your musicians win.
a hip hop artist from Idaho (fka Bella Q)
@Tripod: My belief is that they thought they could piggyback onto local objection to the Hammonds having to serve the mandatory minimum sentences after the federal sentencing judge went below the minimum. I think they also expected a much bigger response to their call for patriot support, since they drew a sizable armed crew to Bunkerville.
Adam L Silverman
@SarahT: I have a 29 exercise workout that I do. It is intended to provide strength, cardio, and core training. And it delivers. I was on a four day split with it, but when I got sick in January and then started working back in, I decided that right now my body needs a three day split. So I’ve gone to that. I’ve also been trying to slow the workout down – my internal metronome runs fast (use should see me doing a tai chi set, it looks like karate kata…). Slowing it down has made everything harder. Including the cardio aspect. I usually follow the TRX with 20 minutes on a Helix machine. I’ve also moved from doing my workout and then going to the dojo. Post cold I’ve had some hydration/electrolyte level issues. So instead of doing the TRX on MON, WED, FRI and then on to the dojo all warmed up, I’ve moved it to SUN, TUES, THURS. I do go and do the Helix for about 20 minutes before the dojo to get warmed up.

And I was in shape from lifting lots of weights, so I became the road manager. Got to go to a lot of good shows for free. And, of course, Emory’s musical royalty was the Indigo Girls.
Adam L Silverman
@a hip hop artist from Idaho (fka Bella Q): I also think they didn’t understand exactly where their bread would be buttered with local support. Sheriff Palmer in Grant County would’ve been the natural ally, not Sheriff Ward in Harney County. Unfortunately the wildlife refuge isn’t in Grant County, its in Harney County. They’re definitely committed, but they’re clearly not deep or strategic thinkers.
Adam L Silverman

SarahT
@Adam L Silverman: Yikes that’s impressive – and better you than me !
Cheryl Rofer
Okay, @Tripod, I’ll bite. Probably shouldn’t because I’m not a night owl like Adam Silverman, but here goes.
If we assume a Bundy conspiracy to return federal lands to the states, or whatever their goal is, then this was most likely a target of opportunity. That conspiracy would include the Bundys and the hangers-on who are being indicted with them, with a few exceptions like David Fry. The jail sentences for the Hammonds were irregular enough that they thought the cause would rally the militias, and the issue on which the Hammonds were returning to jail was relevant to the cause.
It’s a nice question whether specifically a takeover of Malheur was planned. Presumably we will find out more about that during the Bundy’s trials. But let’s say it was. Not many people there during winter, so it would be easy to do and maintain. That would bring more supporters (with snacks), and the whole movement would be on a roll. Occupy Malheur, take over the Burns city government (think about that community meeting that the Bundys and friends attended), and you would have a mini-state. Maybe it could even be extended to John Day, with its friendly sheriff. Again, we may learn more about just how friendly he was during the trials to come.
It’s easy, when one is obsessed by a cause that one believes is for everyone’s good, to believe that others feel similarly strongly. But few are willing to risk their necks and futures. One of the supportive groups even recognizes this in their name – the III%, for the putative three percent that actively supported the American Revolution. But they missed that lesson for their own cause. Probably not even three percent.

Their biggest weakness is staying in their bubble so they only hear and believe their own bs.
Example: Cliven going to Oregon. Fiore talked him into flying commercial — so convenient! And it seemed sensible to all of them to announce those travel plans to the world on Facebook.
Of course the feds arrested him in the airport. They even signaled they were up to something by separating him from Fiore so he arrived alone on a later flight.
They’re all so sure of their ridiculous ideas about their imagined constitution and the silly stuff about admiralty courts and county sheriffs. They act all shocked and injured when any of them get arrested. They know they’re right and can’t believe that the whole country doesn’t agree.
It will be very interesting to hear who is paying for all of this. How the Bundy ranch made enough to feed Cliven and his wife, much less keeping their raft of children and grandchildren in cowboy hats, guns, and MacBooks, will be an interesting story. All this while Cliven is so poor he can’t afford a lawyer. Sure.
I’m looking forward to seeing their funding sources come out during the trials.
Adam L Silverman
@nutella: Ag subsidies and selling ungraded/not inspected beef out of a fridge on his ranch. My guess is when they dig down into the funding they’re going to find the who’s who/usual suspects of local ownership of Federal lands organizations and special interests. And then it gets interesting. Its where we see if the US Attorney decides to creatively apply the material support to terrorism statute to a domestic group. Or if RICO rears its head.

LAO
@Adam L Silverman: I can’t see the US Attorney charging either RICO or the material support for (domestic)terrorism. The charges out of Nevada are already so serious, especially with the mandatory consecutive time for the 924(c) charges. (I calculate 22 years on the weapons charges alone).
a hip hop artist from Idaho (fka Bella Q)
@efgoldman: Boston sure is! Thomas Schippers was a wonderful gentleman. I knew him – just barely socially- in my teens. I can’t recall which one of my parents’ friends had cocktail parties that included teens, but that’s how I met him.
Keith I knew as an adult because we had friends in common, so I knew him much better socially.
Mr. Q got his masters in composition here, which is how we met, but oddly, I still know most of the musicians with recognizable names.
Adam L Silverman
@LAO: the issue is that material support for terrorism statute was written for, and has only been used for, foreign terrorist organizations. So the trick will be trying to stretch it for domestic.
LAO
@Adam L Silverman: I’m not saying it couldn’t fit. I watched with horror the 2d circuit’s treatment of Lynne Stewart (a truly unpleasant person-but a fellow defense attorney). I just think, actually calling them domestic terrorists, would engender a degree of support for the bundys that the doj wishes to avoid.
Frankly, RICO fits as well. Maybe I’ve become softhearted in my old age. I actually hope that the government doesn’t do it. Not because I respect the bundy’s actions but because I hate when the government overcharges.
Feudalism Now!
I would figure the RICO avenue would be used to charge the monied interests behind the Bundys.
Mnemosyne
@efgoldman:
I went to see a John Williams concert with some coworkers at the Hollywood Bowl a few years ago. At one point, an LAPD helicopter started hovering nearby, so he halted the orchestra and shook his fist at the intruder. It got a good laugh from the audience.
LAO
@Feudalism Now!: that’s not how the Feds use RICO in NY (where I practice). so maybe?
nutella
Yes, they need to avoid piling on more charges than are actually justified by the crimes committed. That is, not what the federal prosecutors did to Aaron Swartz. We don’t want to make the Bundy defendants look like martyrs to a vindictive government but like criminals getting punishment commensurate with their actual crimes.
a hip hop artist from Idaho (fka Bella Q)
@LAO: The Nevada weapons charges are key, as you note because of the mandatory consecutive for 924(c). So there’s no need to add anything tricky.
@Adam L Silverman: There’s not really a call for material support charges and fighting that uphill battle. There will be a case perhaps that they’ll want to try that argument; this isn’t it. And there’s plenty of documentation of Parker’s involvement. I’ve always been sure they had eyes on him, now the question is how to grab him safely. He’s dangerous not only because of the weapons, but he seems smart enough to stay quieter than the rest.
@LAO: Seconded.

Now is a good time to quote from the High Country News article you linked to in your last post. I think folks got stuck on the author’s early comments, “For loving wilderness and empty lands and birdsong rather than teeming cities, I risk being called a xenophobe, a noxious nativist. For viewing guns as constitutionally protected, essential tools of self-defense and, if need be, liberation, I’m told that I defend the massacres of innocents in mass shootings.” and didn’t get to the real meat of the article at the end:

@efgoldman:
So very sorry.

LAO
@efgoldman: I can’t help it. Been a federal defense attorney for 18 years and have watched how mandatory minimums and the sentencing guidelines (when mandatory) really give prosecutors all the power. That is not how our system should operate.
Also (as a long time lurker and rare poster) please accept my condolences. People suck.
a hip hop artist from Idaho (fka Bella Q)
@LAO: It cannot be stated loudly enough that referring to the Bundy crew as “domestic terrorists” in a pleading risks provoking dangerous support for the cause that we’re all better off without. Thus I’m repeating what you said.

Losing one’s parents or siblings is the same part of life that we all experience. It is not a pleasant experience, not in the least, nor one that we normally contemplate. But it happens. I’ve lost my father and sibling to disease and mom to just plain old age. But life goes on, however tough it sounds. I used to say it gets easier but never better. But I think really it’s just that you get acclimated to it, accepting to a degree so to speak. But having someone steal that life away, that’s got to be exponentially more difficult.
Adam L Silverman
@a hip hop artist from Idaho (fka Bella Q): Tracking on that. I didn’t think they’d try it here. However, if they’re going to go after whoever’s funded this they’re going to have to have something stronger than just a conspiracy charge. None of these folks have a lot of money, and the few with property seem to not have much in the way of liquid assets.

Just checked on FB and there was a post about the Kochsucker brothers and their owning of hundreds of thousands of acres of land, along with several other very wealthy individuals who want to privatize every sq ft of federal land they can. Wouldn’t put it past any of them to incite these idiots to get the idea of privatizing land, just like it’s been tried with every other thing which the government should be doing, prisons, education, etc. They don’t want citizens to have any control of any institution that they can run in their own sick way and for profit, only to them.

Soylent Green
The government wants a year or so to prepare its case, but today the public defenders for the Malheur perps will be arguing that this is a “simple” case that should go to trial this April.
I don’t know why, except for Ammon, the gang is being defended by court-appointed lawyers unless sticking it to the taxpayers in yet another way is more important to them than a strong defense. Surely there are enough supporting yahoos (and corporate backers) to cough up the money for a legal team.
a hip hop artist from Idaho (fka Bella Q)
@Soylent Green: They all probably quite legitimately qualify for PD representation because none of them seem to have any income. Mrs. Anderson worked at a gas station before heading off to the occupation. That kind of income stream will qualify. Sticking it to the taxpayers is just a bonus for them.
And speedy trial issues are a legitimate concern when defendants are incarcerated pretrial. Given the sheer amount of crime scene processing alone, I don’t think this case will fail a “complex case” analysis.
Ironically, the PD clients will in all likelihood have much better representation than one of the true believers with a law degree can provide. Folks who do public defense work tend to have lots of experience with criminal law.
Adam L Silverman
@Mj_Oregon: Fixed! Thanks.
