@Villago Delenda Est: IANAL but the decision said that the motion of an injunction was filed at 10:30 pm on April 30 with the claim that “the administrative provisions at issue are scheduled to go into effect (and Texas will be irreparably injured if they do not) at midnight tonight [April 30].” and that Judge Smith bought that claim in issuing the injunction.
However, in their response, PP included an affidavit from a state official that contradicted the need for an emergency injunction “Language in that affidavit reasonably calls into question the State’s declaration of an emergency need for a stay, because it states that any injunction will have the effect of requiring the State to cease operating the program at issue “upon termination of federal funding.” Evidence in the record indicates that such funding is continuing until November 2012.“.
So the three judge panel, which included Judge Smith, ruled there was no need for an emergency stay after allsince the injunction won’t affect the State until November 2012. A good decision to be sure, but I am not sure how much practical difference there is in having the ruling reversed if nothing was going to change before November anyway. (EDIT: I could not tell if the panel decision was unanimous)

Also, something very important was going to change before November – Planned Parenthood was going to stop getting reimbursement for providing health care services, effectively immediately. Now Texas has to continue reimbursing them until the appeal is decided.

I think this is going to be a close election, about no matter what. I think it will be highly tribal, and outside news, unless epic in nature, whether good or bad will have little effect on the split that we saw in the voting for 2008.
Also, in this way, unlike any election we’ve ever had with the first black president asking the country to be reelected for another 4 years. In a white majority country, there are all kinds of reasons why such a proposal, is tricky, at least as tricky as the issues themselves and Obama’s record.
And unfortunately for Obama and dems, there will be a ceiling of possible votes received, and I see no reason why it should be any different than the voting in 2008.
Accordingly, republicans will have a floor of vote totals similar to the 2008 election, regardless of economic conditions improving as they are, slowly.
But the ceiling dems have, I don’t think exist for republicans, and Romney will be given wide sway to fuck many chickens before voting day, and he will need every inch of that sway, being the gawd awful candidate he has been and will likely be going forward.
This is where we are as a country on the scale of enlightenment . A little brighter, maybe in some ways, but still with our prejudices in play, as a people.
I think Obama and his aids get this, and why this is nice to see as a campaign strategy for 2012/

That does not say that major corporations and other global warming research groups had knowledge of the individual ads that were made.
In contrast, the Heartland Institute was involved in the the billboard campaign and had prepared press materials to follow up on the billboards.
But if you want, sure, I will go ahead and damn the 10 10 campaign, and tell people they are not be trusted. And I will do the same for the Heartland institute. Fine with me. Global warming science can do very well without the 10 10 group. I have doubts that anti global warming propaganda would do was well without backing of groups like the Heartland Institute. Discredit just a few money bag organizations and the whole effort would fold.
