What’s really frustrating is that they aren’t going to succeed or come even close. And in the end, that’s going to send a message that the strategy that Kagan pursued–being very guarded–will be seen as a very easy and very legitimate one to take. (This isn’t a slam against her, by the way.) Ideally, the hearings should be both a way to judge the soundness of one’s ability to serve, but also as a way to gauge their beliefs. The latter will certainly be far less true. Nobody will benefit.
Now, considering that he’s probably going to have at least one more appointment in him, I really hope he picks a staunch progressive voice for his next pick. The Republicans have pretty clearly demonstrated that they intend to approach this with the seriousness of a five-year-old, so why expect anything different? Why give them the respect they don’t deserve?

Politico has learned that the Republicans and Democrats will be engaging in a game of Go Fish later today. Anonymous sources have confirmed that the GOP has settled on a strategy of asking the Democrats for numbered or face cards that the Democrats may be holding. And the threat of tossing all the cards on the table in the air and yelling “Cheater” is still being considered.

Real establishment journalists shouldn’t write this sort of story because some of their right wing judicial sources might haz a sad and trim access so that they can say unaccountable shit behind the scene.
