The details of the plea deal are out:
Australian David Hicks pleaded guilty at the Guant‡namo Bay Navy Base yesterday to supporting terrorism in exchange for a nine-month prison sentence under a plea deal that forbids him from claiming he was abused in U.S. custody.
In return, Hicks, 31, will be allowed to leave Guana‡namo within 60 days to serve out the sentence in his native Australia. He will be free by New Year’s Eve.
“They told us this was one of the world’s worst terrorists, and he got the sentence of a drunken driver,” said Ben Wizner, staff attorney for the American Civil Liberties Union.
The Bush administration originally had sought life in prison for Hicks. But the presiding officer, Marine Col. Ralph Kohlmann, disclosed that a Pentagon official had cut the deal.
Under the deal, Hicks agreed not to talk to reporters for a year, to forever waive any profit from telling his story, to renounce any claims of mistreatment or unlawful detention and to submit voluntarily to U.S. interrogation and testify at future U.S. trials or international tribunals.
And there you have it. One of the worst of the worst, as we are told, and even after abusing him and trying him in a kangaroo court of their own construction, the best our fearless leaders can get is 9 months. I sure feel safer now that this terrifying menace is off the streets. Maybe they should charge him with jaywalking to up the sentence?
That is how weak their case was, that is how weak this whole system is. The only security that this whole Hicks deal provides is security for the Government- Hicks can’t officially allege he was abused or talk to the press.

If he was dangerous, then a nine-month sentence is wholly inadequate; indeed, a seven-year sentence was wholly inadequate. He received a seven-year sentence, however, all but nine months of which was suspended, provided he wouldn’t talk to reporters for a year. It would seem that he must not have been truly dangerous, no matter where he was captured.

A couple of years ago, to help Blair domestically, we released five of the “worst of the worst” to Britain for trial. A judge looked at the files containing the evidence against them. Within 48 hours he released all five. Said there was nothing there. Damn activist judges, they look at shit like evidence rather than known truth. See, that’s why those guys at Gitmo need to stay there permanently.
When the first plans for tribunals were drawn up, JAG officers were allowed to see the prisoner files. More than one JAG said there were only a handful of real bad guys there. The majority were there because they were slow leaving an area. One JAG said you’d be surprised how many of these guys had been shot in the ass when they were found.
Others were there because bounties had been offered and paid to those in AF who turned in Taliban or their supporters. Seems that could be a convenient way to get rid of your personal enemies or people you owe money to. Some warlords made some good change on that deal. Everybody won. Warlords got money, and the admin got numbers to show.
So what do we have to show for five years of Gitmo? Our reputation shot, our Constitution alternatively interrogated, and one Australian getting nine months and told not to make any money from appearing on the teevee. And don’t talk bad about us.

Hicks has become a rather import issue here in Aus, because of the perceived(?) unfairness of the military commissions.
I certainly hope that the Australian courts will have the opportunity and the courage to throw the whole lot out. The poor guy would have signed anything just to come home. The part about signing a statement saying he was not abused sort of proves, in my mind(not that I doubted it), that he was abused. But hey, he can’t sue now? Maybe he can appear before congress. When his tank was trapped he and his mates hopped out and let the Yanks blow it up, largely because they knew they would get decent treatment from the American soldiers – certainly better than if they had fought, prevailed, and gone back to the German forces. They spent the remainder of the war in Arizona, and the Americans helped him to locate the remainder of his family after the war
Result: a lot of Germans who thought very highly of America, or at least who did before the current administration brought back a lot of unpleasant memories. Now the Germans are the good guys, and the Americans stand to a comparison with the NAZIs — Thanks, EEEL!

4. Muslim Children = future terrorists (can be tortured if parents are present)
5. Gay = torture or summary execution
6. Due process = quaint (God is with our side)
7. Thou shalt not kill = see #6
8. Privacy = What-a-cy?
9. Government = protect the rich
10. Loyalty = you are with us or you are Al Qaeda
11. Freedom = Slavery
These are general guidelines only. As a rule of thumb, if someone is accused, they are guilty. If you need clarification of any terms, see the first edition of the Newspeak dictionary, all other dictionaries are to be confiscated and destroyed.
Regarding #5, it will become more difficult to locate gays once these guidelines are in force, but judicious use of torture should reveal the gays who go underground. Many have adoptive children, so #4 can be applied where necessary.
Regarding #4, we must try not too be too sensitive on this issue, it has been proven that torturing children in front of their parents has yielded important information which has resulted in (redacted) arrests, detentions, and (redacted) executions.
Regarding #2, eventually, when someone refuses the loyalty oath to the supreme commander, this will qualify them for summary execution. That’s only common sense.
