The Senate, under Democratic leadership followed by a Democratic capacity to filibuster, has confirmed more than 140 of the President’s nominees to Federal courts, 10 to the Courts of Appeals.
It is unsurprising that the Democratic majority/minority in the Senate would pay more attention to nominees for higher positions than for lower ones, and therefore it makes sense that they would expend political capital on opposing the nominations of judges to the Appellate Courts rather than to the District Courts.
There is a fairly simple solution; the Dems have shown themselves perfectly willing to confirm a supermajority of the nominees which the President has put forward — why not just give up the power fantasies and work within the Constitutional system of checks and balances to find compromise candidates?
